Terms and Conditions
These Terms and Conditions govern your use of the BA Unfiltered website and Thinkific-hosted learning platform, your purchase of and access to all products and services offered by BA Unfiltered (including but not limited to online courses, mock exam packs, digital resources, and exam vouchers), and all interactions with BA Unfiltered, a trading name of Esphere Consulting Pty Ltd (ABN 87 663 464 757), located in Point Cook, Victoria, Australia ('we', 'us', 'our'). By using our website, accessing our learning platform, or completing a purchase, you agree to these terms. Where access is granted by means other than a direct purchase — including gifted access, corporate enrolment, or manual addition by us — your use of the platform constitutes acceptance of these terms in accordance with Section 3. If you do not agree, do not proceed with enrolment.
1. Who We Are
BA Unfiltered is the trading name under which all online certification preparation and practitioner courses are offered by Esphere Consulting Pty Ltd. Our courses are delivered through Thinkific, an online learning platform. Our contact details are:

2. What You Are Buying
When you purchase a product from BA Unfiltered, you are buying a personal, non-transferable licence to access self-paced online learning content hosted on our Thinkific site. Your licence gives you:
- Access to all course videos, slides, and written content for the access period stated at checkout. Where the course listing states 'platform access' or a similar term, this means access for as long as the course remains commercially available on the BA Unfiltered platform. We will provide at least 90 days' written notice to enrolled learners before permanently retiring a course, during which time you may download any resources marked as downloadable.
- The right to download resources marked as downloadable within the course
- Access to knowledge check quizzes and any locked resources that become available on completion of those quizzes
- Where an exam voucher is purchased: a single-use voucher code redeemable with the relevant examination body for one examination sitting, subject to that body's terms, conditions, and expiry period.
Your licence does not include the right to copy, reproduce, share, resell, or sub-license any course content to any other person. All course content — including videos, slides, worksheets, scripts, and written materials — is the intellectual property of Esphere Consulting Pty Ltd (trading as BA Unfiltered) and is protected under the Copyright Act 1968 (Cth). Unauthorised reproduction or distribution constitutes copyright infringement, and we reserve the right to pursue legal remedies, including damages and injunctive relief.
3. Enrolment and Access
Access to your course begins immediately upon successful payment confirmation unless otherwise stated on the course page. You will receive a confirmation email with login details. If you do not receive access within 24 hours, contact us at [email protected].
Before enrolling, please ensure your device, browser, and internet connection meet the technical requirements for accessing the Thinkific platform. Current technical requirements are listed on the course enrolment page. If you have accessibility requirements or need to discuss whether the platform can accommodate a specific need before purchasing, please contact us at [email protected] prior to enrolment. We will make reasonable efforts to advise on available options.
Sequential course structure
Course content is delivered in a structured, sequential format. Lessons must be completed in order; each lesson requires the previous lesson to be completed before it becomes accessible, based on a minimum video completion threshold. Module progression requires completion of the knowledge check quiz at the end of each module. You cannot access Module 2 content until the Module 1 knowledge check has been submitted, and so on for each subsequent module.
This structure is intentional and forms part of the course design. Inability to progress through a course solely due to its sequential design does not constitute a failure to provide access to the course and does not qualify for a refund under Section 5, except where a platform error — not the sequential design itself — prevents a lesson from being recorded as complete through no fault of your own. If you believe a platform error is preventing your progress, contact us at [email protected], and we will investigate within 5 business days.
Single-user licence
Each purchase is for one individual learner. You must not share your login credentials with any other person. Our platform records access by IP address and device. If we detect that an account is being accessed by multiple users simultaneously or from patterns inconsistent with single-user use, we may suspend access without prior notice. Where you believe a suspension has occurred in error, contact [email protected] and we will review and respond within 5 business days. The original purchaser remains liable for the full course fee regardless of suspension for breach of this condition.
Manually enrolled learners
Where access is granted by any means other than direct purchase — including gifted access, corporate enrolment, or manual addition by us — the learner's use of the platform constitutes acceptance of these Terms and Conditions and our Privacy and Cookie Policy.
Corporate and third-party purchases
Where a course is purchased by an organisation on behalf of an individual, the purchasing organisation is the contracting party and is responsible for all payment obligations. Access is granted to the nominated individual only. If that individual leaves the organisation, access is not transferable. Refund or remedy requests from corporate purchasers must come from the purchasing organisation.
4. Pricing and Payment
4.1 Prices — General
All prices are displayed in United States dollars (USD). The total amount payable at checkout depends on your location, as set out in Sections 4.2 to 4.4 below.
4.2 Australian Consumers — GST
For purchases made by Australian consumers, the displayed price is inclusive of Goods and Services Tax (GST) at 10%. Esphere Consulting Pty Ltd (ABN 87 663 464 757) is registered for GST.
Payment receipts are issued automatically by Thinkific Payments upon purchase confirmation. If you require a formal tax invoice setting out the GST component, this is available on request by emailing [email protected]. We will provide a tax invoice within 28 days of your request, in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
4.3 US and Canadian Consumers — Sales Tax
For purchases made by customers located in the United States or Canada, the displayed price does not include sales tax. Thinkific operates as a Marketplace Facilitator and Digital Platform Operator in the United States and Canada. Thinkific automatically calculates, collects, and remits applicable sales tax on our behalf at checkout. The final price shown at checkout will include any applicable sales tax.
We do not receive, retain, or have any direct liability for the sales tax amount calculated, collected, and remitted by Thinkific in its capacity as Marketplace Facilitator. For questions about the calculation or refund of sales tax on your transaction, contact Thinkific directly. Any refund of sales tax in connection with an approved refund is processed by Thinkific through its Marketplace Facilitator mechanism.
4.4 All Other Consumers
For consumers located outside Australia, the United States, and Canada, the displayed price in USD is the total price payable. No GST or other tax is added to your purchase by us or by Thinkific at checkout.
4.5 Payment processing
Payments are processed securely through Thinkific Payments. We do not store your card details — all payment card data is transmitted to and handled by Thinkific Payments. By making a purchase, you are also subject to Thinkific's terms of service, which govern the payment processing relationship.
4.6 Buy Now Pay Later (BNPL)
Where available at checkout, we offer Buy Now Pay Later (BNPL) options through third-party providers including Afterpay and Klarna. These providers pay us the full purchase amount at the time of your transaction. Your instalment arrangement is directly with the BNPL provider and is subject to their own terms, credit assessments, and fees. We are not responsible for any arrangement between you and the BNPL provider.
Where an approved refund is due on a BNPL purchase, we will process the refund back through the BNPL platform. Any resulting adjustment to your instalment schedule is managed by the BNPL provider under their own terms. Contact your BNPL provider directly for questions about your repayment arrangement.
In the event of a dispute raised by you with a BNPL provider, we will provide the provider with evidence of course access, including platform engagement records and timestamps, in support of our position.
Gift access purchased via a BNPL method is non-refundable. By selecting a BNPL payment method to purchase gifted access, you acknowledge that course access is provided to the gift recipient upon issuance of the gift code, and that this constitutes delivery of the product. This non-refundable condition will be displayed at checkout for BNPL gift purchases.
5. Refunds and Your Consumer Rights
5.1 Australian Consumer Law
Our courses are supplied as services; mock exam packs, digital resources, and exam vouchers are supplied as digital goods. All are subject to consumer guarantees under the Australian Consumer Law (ACL). These guarantees cannot be excluded, restricted, or modified by any contract term. Under the ACL, you are entitled to a remedy if a course or product:
- Is not fit for the purpose described — for example, where the content is materially different from its stated description and learning outcomes
- Cannot be accessed due to a fault on our side that we cannot fix within a reasonable time — for example, a persistent platform error preventing login that is not resolved within 7 days
- Is not delivered with due care and skill
Where there is a major failure, you may choose the remedy that applies to your situation. Your options include: (a) a full refund of the amount you paid; (b) compensation for the reduction in value of the product or service below the price paid; or (c) another available remedy under the Australian Consumer Law. The choice of remedy is yours. Where there is a minor failure, we will fix the problem or re-supply the affected content within a reasonable time. Approved refunds under the ACL are processed within 5 to 10 business days of the approval date.
5.2 Voluntary Refund Policy — by Product Type
In addition to your rights under the ACL, we offer voluntary refund entitlements that vary by product type, as set out below. Approval of a refund and termination of access does not authorise the retention of any course content captured during the access period. All screenshots, recordings, transcriptions, and any other copies of course content — whether in digital or physical form — must be permanently deleted immediately upon refund. The obligations under Section 8 (Intellectual Property) survive any refund and access termination and continue to bind you.
5.2.1 Individual Courses
If you are not satisfied with your course purchase, you may request a full refund within 14 days of your purchase date, subject to the conditions below. Where access is delayed beyond 24 hours after purchase for reasons within our control, the 14-day window commences from the date on which access was actually granted, not the purchase date.
This 14-day period also satisfies the statutory right of withdrawal available to consumers in the European Union under the Consumer Rights Directive (2011/83/EU) and in the United Kingdom under the Consumer Contracts Regulations 2013. By accessing course content within this period, EU and UK learners acknowledge that they have requested immediate delivery of digital content, and accept that the right of withdrawal may be limited by the conditions below.
A refund will not be available where you have:
- submitted the knowledge check for more than one module; or
- accessed more than one module's Answer Key.
Answer Keys are gated behind each module's knowledge check and become accessible upon submission. Accessing an Answer Key confirms that the learner has both submitted a knowledge check and viewed the model answers for that module — regardless of which module that is. The refund window closes upon submission of a second knowledge check, or upon access to a second Answer Key, whichever occurs first. For the purposes of this section, 'accessed' means the Answer Key content having been loaded and rendered on your account as recorded by the Thinkific platform, regardless of the duration of access or whether the content was intentionally viewed.
To request a refund, email [email protected] within 14 days of your purchase date (or access date, where applicable) with your name and order number.
5.2.2 Mock Exam Packs
Mock exam packs are non-refundable. Exam content is accessible immediately upon purchase — each exam is delivered as a lesson on the Thinkific platform using an interactive standalone examination environment. Due to the technical constraints of this delivery method, BA Unfiltered has no means of verifying whether exam content has been accessed, viewed, or attempted, including how many times an exam has been attempted or how far a learner progressed. Because engagement with exam content cannot be determined, a conditional refund policy cannot be fairly or consistently applied.
By completing your purchase of a mock exam pack, you acknowledge that you have been informed of this delivery method and that no refund is available under our voluntary refund policy.
This policy does not affect your rights under the Australian Consumer Law where a mock exam pack is faulty, materially misdescribed, or otherwise fails a consumer guarantee — for example, where an exam is inaccessible due to a platform error that we cannot resolve within a reasonable time.
5.2.3 Digital Resources
Digital resources (including downloadable worksheets, templates, and reference materials) are non-refundable. By completing your purchase, you acknowledge that digital resources are made available to you immediately upon payment and that access cannot be revoked in a reversible manner. This policy does not affect your rights under the Australian Consumer Law where a resource is faulty, misdescribed, or otherwise fails a consumer guarantee.
5.2.4 Exam Vouchers
Exam vouchers (including IIBA examination vouchers and any other third-party examination vouchers) are non-refundable. By completing your purchase of an exam voucher, you acknowledge that the voucher cannot be refunded or exchanged under our voluntary refund policy. Nothing in this clause limits any rights you may have under the Australian Consumer Law where an exam voucher is defective or not as described.
Exam vouchers are subject to the terms, conditions, expiry periods, and redemption requirements set by the issuing examination body (including IIBA). BA Unfiltered is not responsible for any changes to examination format, scheduling, availability, or voucher validity made by the issuing body after your purchase. It is your responsibility to redeem the voucher within its validity period.
5.2.5 Courses Bundled Together
For the purposes of Sections 5.2.5 to 5.2.10, a 'bundle' means either: (a) a product offered by BA Unfiltered as a single combined purchase at a set price; or (b) an additional product purchased at a discounted price alongside a primary purchase at checkout (sometimes referred to as an add-on or order bump). The refund conditions in Sections 5.2.5 to 5.2.10 apply to both scenarios.
Where a component has no listed standalone price at the time of the original bundle purchase — for example, where it is only offered as part of a bundle — its standalone value for the purpose of any refund calculation will be determined by us in good faith based on the pricing of comparable products. We will provide written reasons for the valuation on request.
Where a bundle refund calculation in Sections 5.2.6 to 5.2.10 produces a zero or negative result — for example, where the standalone price of the non-refundable component equals or exceeds the total bundle price paid — no refund is available for the refundable component. In that scenario, the refundable component was effectively included in the bundle at no additional cost.
Where you have purchased two courses as a bundle (as defined above), the following refund conditions apply within 14 days of your purchase date.
Full refund: If you have not submitted more than one knowledge check and have not accessed more than one Answer Key for either course in the bundle, a full refund of the amount you paid will be provided.
Partial refund — one course used: If you have submitted more than one knowledge check or accessed more than one Answer Key for one course but not the other, you will not receive a refund for the course you have engaged with. That course will be assessed at its full standalone price, regardless of the discounted price you paid for it as part of the bundle. The refund amount will be the total amount you paid for the bundle, minus the full standalone price of the course you have engaged with, as listed at the time of your original bundle purchase. No refund will be issued if the resulting amount is zero or negative.
Example: Course A standalone price is USD 247. Course B standalone price is USD 197. You purchased Course A at USD 247 and added Course B at a bundle price of USD 100 (total paid: USD 347) during checkout. If you completed a knowledge check for Course B and request a refund, your refund will be: USD 347 (total paid) minus USD 197 (Course B full standalone price at the time of original purchase) = USD 150.
No refund: If you have submitted more than one knowledge check or accessed more than one Answer Key for both courses, no refund is available.
5.2.6 Course Bundled with Mock Exam Pack
Where you have purchased a course and a mock exam pack as a bundle (as defined above), the following conditions apply within 14 days of your purchase date.
The mock exam pack component is non-refundable (see Section 5.2.2).
For the course component, the 14-day refund conditions in Section 5.2.1 apply. If you are eligible for a refund on the course component, your refund will be the total amount you paid for the bundle minus the full standalone price of the mock exam pack, as listed at the time of your original bundle purchase, regardless of any discounted price paid for it as part of the bundle. No refund will be issued if the resulting amount is zero or negative.
No refund is available for any part of the bundle if you have submitted more than one knowledge check or accessed more than one Answer Key for the course component.
5.2.7 Course Bundled with Digital Resource Pack
Where you have purchased a course and a digital resource pack as a bundle (as defined above):
- The digital resource component is non-refundable (see Section 5.2.3).
- For the course component, the 14-day refund conditions in Section 5.2.1 apply. If you are eligible for a refund on the course, your refund will be the total amount you paid for the bundle minus the full standalone price of the digital resource pack, regardless of the discounted price you paid for it as part of the bundle. No refund will be issued if the resulting amount is zero or negative.
- No refund is available for any part of the bundle if you have submitted more than one knowledge check or accessed more than one Answer Key for the course.
5.2.8 Course Bundled with Exam Voucher
Where you have purchased a course and an exam voucher as a bundle (as defined in Section 5.2.5):
- The exam voucher component is non-refundable (see Section 5.2.4).
- For the course component, the 14-day refund conditions in Section 5.2.1 apply. If you are eligible for a refund on the course component, your refund will be the total amount you paid for the bundle minus the full standalone price of the exam voucher, as listed at the time of your original bundle purchase. No refund will be issued if the resulting amount is zero or negative.
- No refund is available for any part of the bundle if you have submitted more than one knowledge check or accessed more than one Answer Key for the course component.
5.2.9 Mock Exam Pack Bundled with Exam Voucher
Where you have purchased a mock exam pack and an exam voucher as a bundle (as defined in Section 5.2.5):
- The mock exam pack component is non-refundable (see Section 5.2.2).
- The exam voucher component is non-refundable (see Section 5.2.4).
- No refund is available for any part of this bundle.
5.2.10 Course and Mock Exam Pack Bundled with Exam Voucher
Where you have purchased a course, a mock exam pack, and an exam voucher as a bundle (as defined in Section 5.2.5):
- The mock exam pack component is non-refundable (see Section 5.2.2).
- The exam voucher component is non-refundable (see Section 5.2.4).
- For the course component, the 14-day refund conditions in Section 5.2.1 apply. If you are eligible for a refund on the course component, your refund will be the total amount you paid for the bundle minus the combined full standalone prices of the mock exam pack and the exam voucher, as listed at the time of your original bundle purchase. No refund will be issued if the resulting amount is zero or negative.
- No refund is available for any part of the bundle if you have submitted more than one knowledge check or accessed more than one Answer Key for the course component.
5.2.11 Anti-Abuse
BA Unfiltered reserves the right to refuse a refund, or to reverse a refund already processed, where there are reasonable grounds to believe that: (a) an account was created or a purchase made primarily for the purpose of extracting course content rather than genuine learning; (b) multiple accounts appear to be operated by the same individual or organisation in a pattern inconsistent with genuine individual enrolment; or (c) a refund request is part of a systematic pattern of purchase and refund activity, including (without limitation) three or more refund requests across different products within any 12-month period. We may use platform data, IP address records, and account activity to assess these grounds. Where a refund is refused under this section, we will provide written reasons on request.
5.3 Evidence of use
In assessing any refund request, we take into account evidence of course access recorded by the Thinkific platform, including lesson completion, quiz submissions, and resource downloads. This evidence is used to assess the applicable refund conditions above and to determine whether a failure is major or minor under the ACL. This does not remove your ACL rights — it is part of the assessment process. For ACL claims relating to mock exam packs, individual exam engagement data is not captured by the platform as set out in Section 5.2.2; such claims are assessed on the basis of all other available evidence.
Where platform records are unavailable, incomplete, or disputed, we will make a reasonable determination based on all available evidence, including login records, email confirmations, and any other records held by us or our service providers. Our determination will be made in good faith and communicated to you in writing.
5.4 What does not qualify for a remedy
The following do not constitute a failure under the ACL and do not qualify for a refund:
- Change of mind after purchase where the applicable voluntary refund period has expired or its conditions have been exceeded
- Deciding the product was not the right fit after substantive engagement with the content
- Inability to progress through a course due to its sequential structure, where that structure is functioning as intended — this is a design feature described in Section 3. Where a platform error (not the sequential design) prevents progress, Section 5.1 remedies apply.
- Technical issues on your own device, browser, or internet connection not caused by our platform
- Purchase of a non-refundable product — mock exam packs, digital resources, and exam vouchers are non-refundable upon purchase, except where your rights under the Australian Consumer Law apply (see Sections 5.2.2, 5.2.3, and 5.2.4).
5.5 How to request a remedy
Email [email protected] with your name, order number, and a description of the issue. We will respond within 5 business days. Where a refund is approved, we will process it within 5 to 10 business days of the approval date. Refunds will be returned to the original payment method. If you are not satisfied with our response, you may contact the ACCC at accc.gov.au or your relevant state consumer affairs office.
Refunds will be processed in USD to the original payment method. Where your bank or payment provider converts the refund to your local currency, the exchange rate applied will be determined by your bank or payment provider at the time of the refund. We are not responsible for any difference in the local currency amount compared to the amount originally paid.
BNPL and US/Canadian tax refunds: Where Thinkific has collected sales tax on a purchase as Marketplace Facilitator, any approved refund will be processed in accordance with the applicable refund conditions in Section 5.2, including the tax component where collected by Thinkific as Marketplace Facilitator — Thinkific processes the tax portion automatically. For BNPL purchases, we will process the refund through the BNPL platform and the provider manages any instalment adjustment. To request any refund, email [email protected] with your name and order number.
Chargebacks: Where you initiate a payment dispute or chargeback directly with your bank, card issuer, or payment provider rather than contacting us first, we will provide the payment processor with evidence of course access and engagement, including platform records, login timestamps, and relevant correspondence. We encourage you to contact us at [email protected] before initiating a payment dispute — this is the fastest way to resolve any issue.
6. IIBA Alignment and Certification
BA Unfiltered is an IIBA Essential Training Partner (ETP). Our courses are developed in accordance with IIBA guidelines and draw directly from IIBA publications, including the BABOK® Guide v3. As an ETP, our courses are recognised by IIBA as meeting its standards for professional development in business analysis.
Our courses may be eligible for IIBA Continuing Development Units (CDUs) and Professional Development (PD) hours. However, CDU and PD hour claims are subject to IIBA's own requirements and eligibility rules, and it is each learner's sole responsibility to verify eligibility and submit claims to IIBA accurately. Completion of an endorsed course does not guarantee a specific certification outcome. Certification decisions are made solely by IIBA.
7. Course Content and Updates
We may update, improve, or modify course content from time to time to reflect developments in the field, correct errors, or improve quality. Where content is materially improved, the updated version will be available to learners who were enrolled at the time of the update at no additional charge. New courses or substantially new versions may be offered as separate products. Where a course is substantially revised, enrolled learners will retain access to the version available at the time of their enrolment for the remainder of their access period, or may transition to the updated version at no additional charge.
We are not liable for any temporary unavailability of course content due to circumstances beyond our reasonable control, including third-party platform outages, scheduled maintenance windows, or force majeure events. For these purposes, 'force majeure' means any event outside our reasonable control, including but not limited to natural disasters, acts of government, pandemic, war, civil unrest, telecommunications or internet failures, or acts or omissions of third-party service providers. Where a platform outage prevents access to a course for more than 7 consecutive days, affected learners will receive a proportionate extension to their access period. An access extension under this section is the primary remedy for platform outages caused by third-party providers. Where an outage meets the threshold for a major failure under the Australian Consumer Law, your rights under Section 5.1 are not affected.
8. Intellectual Property
All course content is the intellectual property of Esphere Consulting Pty Ltd (trading as BA Unfiltered) and is protected under the Copyright Act 1968 (Cth). You must not copy, reproduce, distribute, share, screen record, resell, or create derivative works from any course content without our prior written permission. This includes sharing login credentials, recording videos, or redistributing downloadable resources.
The licence granted under Section 2 does not permit use of course content, methodology, curriculum structure, or assessment design for the purpose of creating, enhancing, or benchmarking competing educational products or services. Purchases made primarily for competitive intelligence gathering are outside the scope of the licence granted and constitute a breach of these terms. Where access is terminated on this basis, no refund under Section 5 will be payable.
BABOK v3 is the intellectual property of IIBA. References to BABOK v3 within our course materials are for educational purposes in accordance with permitted use.
9. Completion Certificates
A certificate of completion is issued automatically by the platform when you meet the completion threshold for a course, based on platform-recorded engagement data. This certificate records that you accessed and completed the course content as tracked by the platform. It does not certify competency or professional standing.
Any use of the completion certificate for professional certification purposes — including claims for IIBA CDU or PD hours — is the learner's sole responsibility. We do not verify, submit, or guarantee the acceptance of any CDU or PD hour claim made to IIBA or any other body on the basis of this certificate. Where a refund is approved and course access is terminated, any completion certificate previously issued for that course is automatically invalidated. An invalidated certificate must not be used for any purpose, including IIBA CDU or PD hour claims. BA Unfiltered reserves the right to notify IIBA of any certificate invalidation arising from a refund.
10. Disclaimers and Limitation of Liability
Our courses are designed to build professional knowledge and skills in business analysis. They are not a substitute for legal, financial, regulatory, or other professional advice specific to your situation.
To the fullest extent permitted by applicable law, our courses are provided on an as-is basis. We make no warranties beyond those set out in these terms and those that cannot be excluded under the Australian Consumer Law or other applicable law.
To the extent permitted by law, our total liability to you for any loss or damage arising from your purchase or use of any product is limited to the amount you paid for the relevant product. We are not liable for any indirect, consequential, or incidental loss.
Nothing in this section limits liability for death or personal injury caused by our negligence, for fraudulent misrepresentation, or for any other liability that cannot be lawfully excluded or limited under Australian law, including under the Australian Consumer Law.
11. Changes to These Terms
We may update these Terms and Conditions from time to time. The current version with its date will always be available on our course site. If we make a material change, we will notify enrolled learners by email. Continuing to use our site after a change is posted constitutes acceptance of the updated terms for future purchases and interactions. For learners already enrolled at the time of a material change, the terms applicable at the time of their original purchase continue to govern their refund and access rights in relation to that purchase.
12. Governing Law and Disputes
These terms are governed by the laws of the State of Victoria, Australia. Any disputes arising from or relating to these terms or your use of our courses will be subject to the non-exclusive jurisdiction of the courts of Victoria, except where you have rights under the Australian Consumer Law to bring a dispute in another forum.
We encourage you to contact us first at [email protected] before escalating any dispute. We will endeavour to resolve complaints within 10 business days.
